Prohibited the dumping of industrial waste water using pits
For the point source pollution, the draft stressed that prohibited the use of seepage wells, pits, cracks, caves and other emissions, the dumping of industrial waste water, sewage, waste water containing pathogen, hazardous waste, sludge and other waste.
The use of rock formations, pores, fissures, caverns and abandoned pits shall be strictly prohibited to store petrochemical raw materials and products, pesticides, radioactive substances, hazardous wastes, sludge and other toxic and harmful chemicals.
At the same time, enterprises and institutions that may cause groundwater pollution should formulate emergency plans for the treatment of groundwater pollution. The occurrence of groundwater pollution incidents or other emergencies caused or may cause the contamination of groundwater, shall be immediately launched the emergency plan, emergency measures, place the people's governments above the county level to report events, and report the incident to the people's Government of the water administrative departments and environmental protection departments for the record.
The major infrastructure protection areas are forbidden mining areas
For the prohibition of groundwater mining area, the draft has also made a clear provision.
One of the following circumstances, should be designated as a prohibited area: serious ground subsidence, ground fissure, sea (salty) water intrusion, vegetation degradation and other geological and ecological environment problems in the region; public water supply network coverage area or underground water has solve the problem of water supply through alternative sources of water overdraft protection area, major infrastructure; key cultural relics protection units in the scope of protection and other laws and regulations prohibit the exploitation of groundwater of the region; the provinces and autonomous regions and municipalities directly under the central government that need to be designated as the other circumstances prohibited area.
The strategic reserve of groundwater should give priority to the protection of domestic water
In addition, the draft also referred to the "strategic reserve of groundwater."".
The draft pointed out that the water administrative department of the local people's governments at or above the county level administrative regions according to the groundwater conditions, climatic conditions and strategic reserves of water resources needs, reasonably determine the groundwater reserves, reserve position and strategic layout scheme, making use of strategic reserve plan, approved by the people's government at the same level.
In addition to special drought years and major emergencies, the strategic reserve of groundwater shall not be used. The strategic reserve of groundwater should be used preferentially to guarantee the living water for urban and rural residents.
Pollution of groundwater and impose fines of up to 500 thousand yuan
Pollution of groundwater should bear what legal responsibility, the draft also made clear regulations.
The draft said, in violation of the regulations, causing groundwater pollution, by the local people's government at or above the county level environmental protection departments shall be ordered to stop the illegal act, to take control measures to eliminate pollution, impose a fifty thousand yuan fine of not less than five hundred thousand yuan; if it fails to take measures, the competent department of environmental protection can be specified with the governance capacity the units on behalf of governance, the cost borne by the violator; constitutes a crime, shall be investigated for criminal responsibility according to law.
Those who violate the provisions of these regulations to produce, sell, transfer or use the technology, equipment and products that seriously pollute groundwater shall be punished in accordance with the provisions of the seventy-seventh law of the People's Republic of China on the prevention and control of water pollution.
